The controversial online spying laws Ottawa has promised to reintroduce in Parliament could force independent Internet service providers to shut down, an industry advocacy group says.

The Canadian Network Operators’ Consortium, a trade group composed of 25 small and mid-sized ISPs, says the “lawful access” legislation the Conservative government has promised could put Internet providers out of business with its requirement that they retrofit their networks so that law enforcement can monitor communications in real time.

The Conservatives introduced a set of three bills in the last Parliament that would vastly expand the ability of law enforcement to gather information online. One provision would force Internet providers to hand over subscriber information -- such as names, email addresses and phone numbers -- without a warrant.

Another provision would require Internet providers to upgrade their networks so that law enforcement can “tap in” to online communications and monitor web activity in real time.

It’s that part of the legislation that has the CNOC worried.

“The degree of network monitoring and surveillance they’re asking for is alarming in terms of its costs,” CNOC President Bill Sandiford told the Huffington Post. “If [some of these] small ISPs need to spend $1 million to be compliant … that could mean the end of them.”

Sandiford, who is also president of Toronto-based Telnet, said he saw the legislation as “excessive,” and cited his own ISP's cooperation with police investigations as evidence the current system is working.

“We’ve co-operated with law enforcement many, many times over the years,” he said, but if the cost of co-operation skyrockets, “who’s going to compensate us for this?”

The final shape of the legislation is uncertain, as the federal government hasn’t yet reintroduced the bills in the latest parliamentary session. Tech law expert and HuffPost blogger Michael Geist expects the government to introduce something similar to last year’s bills before the end of this year.

The legislation has been condemned by many digital rights activists -- as well as provincial and federal privacy commissioners -- as a potentially dangerous expansion of police power, and as the thin end of the wedge to an unaccountable surveillance state.

At an industry panel in Toronto last week, Geist told representatives of the independent ISPs that the proposed law “dramatically changes the world you live in right now. … It turns you into highly regulated bodies, but regulated by law enforcement.”

In a survey for the federal privacy commissioner’s office this year, eight in 10 Canadians opposed granting government the ability to collect online information without a warrant.

Law enforcement officers and members of cabinet have said the proposed “lawful access” bills are a necessary tool to combat online crime in the 21st century.

The possibility that the legislation could further reduce competition in Canada’s Internet market will likely not be well received by consumer advocates, who for years have been complaining about inadequate consumer choice for ISPs.

Some 94 per cent of Internet subscribers purchase their service from one of the “Big Telecom” firms, such as Bell, Rogers and Shaw. These companies invariably also own the Internet infrastructure from which other ISPs have to purchase bandwidth.

The consumer advocacy group OpenMedia recently launched a “Dump Big Telecom” campaign, urging Internet users to switch to one of the smaller, independent providers, to protest what they see as the monopolistic and anti-competitive practices of the large Internet, cable and wireless providers.

The CNOC’s Sandiford said he sees potential for the proposed surveillance system to be misused. While stressing that his organization is on side with law enforcement on fighting online crime, he said there are concerns the new legislation could be used to “facilitate witch hunts.”

“It would need adequate oversight,” he added.

Sandiford said he surmised from conversations with public officials that the legislation may be aimed at Internet service providers who have not co-operated with law enforcement in investigations.

If you all want to help, sign petitions u can find re these dumb bills! I suggest: letters to all MP's; u can, give a sm. donation to the opposition, help them fight this megalomaniac. Prov. letters to your premiers, tell them u are against these bills (now or future), get each/everyone u know that feels the same way, to do the same thing! Join/support every group you can find: CCLA. Democracy Now, Council of Cdns, Leadnow.ca, Openmedia.ca etc. There is a lg list of grps fighting this govt. - become aware of them, join them, and be as active as you can!!

Where are the right wing trolls now? Why aren't they voicing support for this? Where are lightweights like "CanadaStan" and company? Why aren't they telling us how wonderful this is for Canadians with their illogical, fact-free, flippant remarks?

It's simply amazes me that right wingers are against the long gun registry because it supposedly treats gun owners like criminals, yet when their beloved Harper rams through a bill (or is about to) that treats all Canadians like criminals -- they stay silent.

The Canada I know and love died on May 2nd of this year. In this world you can't give control to people who have a right-wing mind set. Unlike how they claim to be, they are not fiscally responsible. They don't keep out of people's private lives. They are all about control and stripping everyday folks of all their power and pushing the money and power upwards.

On October 23rd 2007, George Carlin went on Countdown and said matter of factly to Keith Olbermann that "This country's finished" referring, of course, to the United States.

With Harper behind the wheel, I feel the same way about Canada.

People might care more what you have to say without all of the vitriole and hateful name calling. Anyway, this is the natural end result of a free market and unregulated capitalism; the eventual extreme poverty of the 99% until everything explodes. 1% that owns the government will wage war against the masses to preserve their financial dictatorship. Canada's socialist healthcare system and massive European style entitlements bankrupted our "democratic" economy even faster than the United States.

There is nothing anybody can do at this point but wait for the end of civilization to arrive. MIght as well try to be happy until then. So, If the "Canada you know and love is dead", by all means move somewhere better. Bye!

A troll is someone who lurks on a political site with the sole purpose of creating trouble. It's a common expression. If you call that hateful, then so be it.

And, of course, you'd blame the entitlements as bringing down the U.S. economy. You conveniently ignore the unfunded wars, the tax cuts for the rich, the massive defense spending, the 6.8 trillion dollars Wall Street sucked out of the economy and so on. Social Security in the U.S. was fully funded until 2037 or something like that. But it fits the right wing agenda to point to it and say "that's the problem, kill it."

It's the same game plan, Harper is following. Bloated military and incarceration spending etc. so he and his followers can one day point to our healthcare system and say it's time to kill it.

And I never said I was going to leave Canada. And if I ever do, you're the last person I would want saying "bye" to me.

Make no mistake - This government is "not" serving the Canadian people. It is openly serving another master since wrangling a majority government. They have shown nothing but contempt for Canadian values and of Canada's history of being at the forefront of free thinking democracy's.
This is just another perfect example of this governments "tail wagging the dog." policy making. Folks will say - hey ,if your not doing anything wrong - you have nothing to worry about. My take is ... If i'm not doing anything wrong, what the hell business is it of theirs ,what i'm doing.
This type of broad scope spying intiative should fall under the Governor General's dept. and should be tanked - along with recinding bill c-36 as the 2 most damaging ideals for a free Canadian democracy. Its simply time for free thinking canadians to WRITE to the GG's office and have him step in and actually DO his job. The ceremonial duties can wait. fyi - ex-conservative voter. (saw this behavior coming and voted differently last election)

Democracy? Um, we're Socialist now if you haven't noticed. Checked your taxes lately? See how many people we pay to not work? See how long it takes to get your doctor's appointment? My GF with a rapidly growing lump on her breast has to wait 3 flipin months to even get a biopsy! There is no right to privacy under Socialism. We have no one to blame but our selves voting in all these liberal Socialists in year after year so we could get all our "free" money and entitlements.

that's ridiculous... how you made those connections is beyond me! Liberal socialists are not the problem... the problems are recent.. like in the last ten years of a conservative government, kind of recent! Our money should have gone to hospitals and more staff, but the conservatives decided that getting into wars and not building the infrastructure, that was needed, was a better option. We were debt free with the liberals (so called socialists) had shorter wait times, more services, better foreign relations, and more money in our pockets... but because of the conservatives we have a debt, recession and spending on stuff we don't need. Yeah, ask your girlfriend if her lump is less important than buying fighter jets, building more prisons and going to war with a third-world country!

I couldn't agree with this initiative more. A year and some odd months ago I left cogeco, the local cable company as their usage based billing got to be ridiculous, and Bell and the other major players (Rogers, etc) are no better. They are all in cahootz to charge users more and more, while internet costs continue to go down, just so they can make more hand over fist profits.

Switch to a smaller provider, like TekSavvy, Acanac, or others available in your region. Much better choices, better rates and more bandwidth.

This is what we get for electing the right wing Reform Party to a majority government. Thanks everybody, now we get Harper and his brown shirts eavesdropping on our private electronic communications without so much as the formality of a warrant. I think there should be a mandatory IQ and current affairs test required before letting people vote, it might cut down on the idiots casting ballots.

Three years from now it's going to be a very different world, and I shudder to think what we will have lost. I hope you liked the tv show Big Brother, it's coming to Canada in a big way.
