RackNine Sues Pat Martin And NDP For $5 Million

RackNine Inc. and its chief executive officer Matt Meier have followed through on an earlier threat and served NDP MP Pat Martin and his party with a $5-million lawsuit Friday.


The Edmonton-based call centre company that is part of the ongoing election calls controversy is suing for defamation, claiming that multiple comments made by Martin, and published by the NDP on its website, demonstrated malice and caused the company to lose business.


RackNine is co-operating with an Elections Canada investigation into suspicious automated phone calls made to voters in Guelph in the last election. The company, which was hired by several candidates for voter outreach, is itself not under investigation.


The statement of claim says that Martin began speaking defamatory words about the company on Feb. 23 at a news conference in Ottawa.


"Martin's words were defamatory, and, in the very least, carried the innuendo that Meier and/or RackNine had committed criminal activity, fraudulent activity, participated in a conspiracy, intimidation, sabotage and/or deceit," the claim says.


According to the lawsuit, Martin made more defamatory remarks later that day when he appeared on CBC's Power & Politics with host Evan Solomon, and on CTV's political talk show, Power Play.


Meier is claiming the NDP published defamatory statements on its website and as a result has named the Official Opposition in the $5-million lawsuit.


He sent letters to Martin and the NDP immediately, asking that an apology be delivered and the statements retracted. But they continued to defame the company and its chief executive owner and Martin had indicated that he had no intention of apologizing, according to Friday's statement of claim.


Meier alleges that the defamatory statements have caused him and his company to be "shunned, avoided, and exposed to hatred, contempt and ridicule" and that Martin and the NDP purposefully tried to maximize the damage to RackNine.


The lawsuit was filed in Edmonton and is seeking:


- General damages of $500,000.


- Aggravated damages of $2,000,000.


- Special damages for lost business income of $2,500,000.


- Punitive damages to be set by the court.


Martin and the NDP have one month to respond to the lawsuit.


The Winnipeg MP, who is known for his sharp tongue, said he met with his lawyer Friday to prepare a response to RackNine's original letter asking for an apology. Then he was served with the lawsuit.


Martin told CBC he is "disappointed" that RackNine would "pull the trigger before they'd even seen the response to their original complaint."


"Classic libel-chill [SLAPP]-suit tactic I guess. How to silence someone with your chequebook," Martin wrote in an email, in reference to a legal tactic aimed at silencing public criticism through litigation.

Canada sends observers to monitor the Presidential elections of other third world countries. In the Ukraine, Egypt, Honduras, Mexico, Canada has played a pinnacle role in ensuring elections were fair and legal. What does this scandal do to our reputation as a nation? Just do as we say, not as we do? This is a real big joke to someone out there. eh Matt?

Wait a minute here, what happened to due process?

People are ASSUMING that all 31,000 complaints are against the tories. We don't know that yet.

Martin has pronounced Racknine guilty before they've had a chance to be judged by our judicial system. Can they expect a fair shake now? How would you like it if you were suspected of a crime and an MP pronounced you guilty in public before you were even charged with said crime?

Don't get me wrong, if they are guilty, nail 'em to the wall. That goes for ALL parties involved in this scandal. But we have to let our system run it's course, and get away from this "straight to the gulags" mentality.

Maybe the people of Canada should unite for a bit and launch a class action lawsuit against Racknine for the measly amount of $1/Canadian for their part in this.

If a landlord allows illegal activity on his property he can be held responsible why not Racknine?

I'm all for a new electoral requirement that All political calls have a live person on the other end and I would much happier if they were volunteers like we used to do it.

Pat Martin and the rest of the pigpile oposition needs to be careful what they say. This is a good example that they cannot just spew whatever they want, and make up whatever they want as thjey have been doing trhoughout this scandel.

I'm pretty sure that it's been verified that RackNine at least had the robocalls float through its system. You can't sue someone for telling the truth.

Is it legal to accept a payment for the conduct of an illegal activity? Can I take money to commit election fraud, and then claim it is all the fault of the people who paid me?

That's what RackNine did, and is now doing. That much IS clear. We may not yet know who paid them, but we know for sure that they carried out the act. Gawd I hope they are not an LLC....

Well..... RackNine: you tok the money, and made the calls. That you say you are cooperating with the police seems a little like the driver of the get-a-way car offering to testify about a bank robbery.

They always say 'follow the money'. RackNine is where the money eventually ended up, or did you do all this pro-bono for some buddies?

It's hard to imagine anyone casting stones at this poor company. All they did was take an order from Mssr. Poutine from Separatist St. that contained shady content. They also apparently did this 1/2 a dozen times to thousands of homes for less than $1100.... (insert eye roll here)

Once all of the evidence is in, if Racknine is responsible for the misleading calls, I'll be happy to see a class action suit against them on behalf of all Canadians.

This is typical of any corporate bully. Those who don't toe the line will be sued or threatened with lawsuits, if they are sued drag it out and ouspend the plaintiff. People of Canada should be sueing this company for assisting in the highjacking of an election. What thing about going to court is sometimes you get more than you ask for. (full disclosure)

Just thinking out loud: We need a more useful idiomatic meaning for Racknine. Like:
"So you sent money to help out that Nigerian prince? Did anyone tell you that was an incredibly Racknine move?"
"Making out with a girl at a party, when your wife is at the same party? How Racknine can you get?"
"Education has it's limits. You can remedy ignorance, but there is no cure for Racknine."

Perhaps as a noun: "Just when you make it Racknine-proof, someone invents a better Racknine."
No, I think an adjective's better, like: "You threw a drink at Charles Barkley's date? You're just to Racknine to live."
