Calgary Landlord Charged $5,000 After Reporting Grow-Op

A Calgary man says a permit fee from the city adds insult to injury in the cost of repairs he must make after discovering a marijuana grow-op in his rental property.

Fraser Tuff rented out a home in the southeast neighbourhood of Mahogany in December.

Tuff called police when he became suspicious the tenant had started a grow-op. A grow-op was discovered inside and Tuff may have to pay up to $40,000 to fix the house.

He also has to pay $5,000 to the city for an environmental inspection permit and $1,800 for a fence around the house.

The city says the $5,000 fee is to cover the cost of city inspectors who supervise the clean up.

“The whole process is going to end up being incredibly costly to me and so looking back on it I kind of wish that I would have just phoned them and said get out now,” he said.

“However, I thought the safe thing to do would be to call the police and the right thing to do would be to get the guy arrested, because if I kick him out of my house he's just going to move into someone else's right?”

Tuff said the city should waive the fee to encourage people to do the right thing.

“I'd like them to do whatever they can to help me,” he said. “I don't expect them to buy materials for my house or pay for the labour to fix it, but I do expect that they don't nickel and dime me with bureaucratic garbage.”

Ald. Diane Colley-Urquhart said the city needs to review these costs.

“We really need to look at the way the bylaw stands and see what kind of discretion we can bring to it so we don't further penalize a homeowner,” she said.

Colley-Urquhart said most grow-ops are owned by organized crime, and the criminals should have to pay all the fees.

As to the topic at hand … there's no way this gentleman should have to pay a dime. Not his fault and he had renos to do anyway. I've seen what these types of ops do to houses. Not pretty. Not safe.

40,000 dollars in damage.
Let me guess
Repair/replace one service entrance because of damage doneby hot-shoting the power 1500.00

Repair/replace damaged interior walls(basement) 1500.00
Mold inspection servive 1000.00
Removal of mold and mold effected materials + disposal 3500.00
permits and inspections 1000.00
replace insulation where effected material and labor 2500.00
drywal lmud and tape 5000.00
paint 1500.00
trim 1500.00
Flooring 2500-5000.
And thats if you did most of the work yourself and it doesn't include the lost revenues on the rental property or the cost of carrying that extra mortgage utilities and taxes.

We're all criminals in one way or another. It's the archaic laws prohibiting the use of marijuana that got both of these men in trouble. It's odd for a society to deem one drug legal (alcohol) that is physically addictive, and directly or indirectly responsible for tens of thousands of deaths per year, while banning another drug (marijuana) that is not physically addictive, impossible to overdose on, and which is directly responsible for 0 deaths per year. Alcoholics are treated like sick people, marijuana users are treated like criminals. What gives?

Ideally this person wouldn't be a criminal. They'd be a productive, tax-paying citizen - and the landlord wouldn't have had this problem. Unfortunately there's a lot of money to be made by keeping it illegal, and our rights are trumped by a corrupt government with a bigoted ideology.

You were pissed about someone breaking the law. Well, the city is pissed that your breaking the law.

Marijuana is a whole lot like a tomato plant. how one causes 40k in damage growing tomatoes is beyond me.

The difference is that tomatoes do not need to be hidden, in secret rooms built in basements and attics. The wiring can be done by a professional for tomatoes.

The reason grow-ops damage homes is because they must be placed in locations they should not in an attempt to keep them hidden.

Legalizing and making it a proper crop with industry standards, proper green houses and appropriate wiring and ventilation would prevent a lot of property damage, remove the criminal element and stop ruining lives with this ridiculous drug war.

It is a user fee so the taxpayers don't pay for what are generally related to businesses that should NOT be subsidized. But it does sound odd upon first hearing this.

Grow ops are dangerous. Regardless of whether you feel that pot should be legal or not, it's currently NOT. These grow ops are dangerous and costly. It's unfair that this landlord has to pay such high fees for something illegal he had nothing to do with

Part of what you get in return for those tax dollars is a regulatory regime that helps ensure that your bud is all that you expect. Unless of course you like it sprayed with Solarcaine or laced with PCP or some other toxin. It also cuts out problems associated with organized crime and dramatically lowers the cost to our criminal justice system. Then there is, of course, the revenue that goes to such things as healthcare and the deficit not to mention all the jobs it would create.

In looking back at the picture that the Huff Post chose to use in this article I think it is very inflammatory. As the picture being used appears to be from a dispensary where people acquire their LEGAL medicine. To tie a "grow-op" to the struggle of individuals to get the medicine they need is very subliminally damaging, you folks sure that there aren't some bias, closet Conservatives on the editorial staff making these decisions?
