Smoke Bomb Montreal: Accused Montreal Metro Smoke-Bombers Detained; Bail Hearing Delayed To May 23

MONTREAL - There were rousing cheers and a standing ovation in the courtroom as four people accused of smoke-bombing Montreal's subway system last week made a brief appearance Monday.

The accused had been hoping to obtain their conditional release but instead were forced to remain behind bars as their bail hearing was postponed until next week.

The suspects, Francois-Vivier Gagnon, 22, Genevieve Vaillancourt, 25, Vanessa L'Ecuyer, 22, and Roxanne Belisle, 23, smiled and acknowledged family and friends packing the courtroom as they stood in the prisoners' box.

The visitors' gallery, packed with some of their friends, fans and family, showered the accused with hearty applause as they were led away.

As they walked out in handcuffs, family members blew kisses and mouthed words of support. One suspect's younger sibling sobbed.

The four have been detained since turning themselves in to authorities Friday and were arraigned over the weekend on several charges: perpetrating a terrorist hoax; mischief of more than $5,000 and conspiracy to commit mischief. Gagnon is also charged with possession of a prohibited weapon for allegedly having a butterfly knife in his possession.

The charge of perpetrating a terrorist-related hoax carries a maximum five-year prison term. The charge was created through with an amendment to the Criminal Code after the events of 9-11 and it has been used previously by the Crown, prosecutor Steeve Lariviere said Monday.

He said he will oppose the bail request, on the grounds of ensuring public confidence.

The delay Monday was caused by a procedural problem. The defence had not received the Crown's evidence and both sides needed more time to prepare their case.

The three women and one man are accused of tossing smoke bombs into various subway stations last Thursday, shutting down service during rush hour. It caused a frustrating morning commute for tens of thousands of Montrealers and prompted a mass evacuation of the transit system.

The Crown declined to go into specifics about the case, such as whether the four were believed to belong to a specific group.

"(The hoax) was basically linked with a public service and that's why this charge was brought forward," said Lariviere.

"It's to make sure that public services are not held hostage by that type of infraction."

There were tense scenes outside the courtroom Monday.

Some protesters accused the media of being biased against their cause and they obstructed television cameras seeking to get footage.

They repeatedly swore at journalists who asked for interviews.

Some of their anger stemmed from the fact that one of the suspects had been misidentified in various media before the arrests were made. One of the names circulating in media reports never appeared on the charge sheet.

Lawyer Veronique Robert, who currently represents two of the accused, said the suspects all come from good families. She said outside the Montreal courthouse that the four are holding up well, considering the circumstances.

"They're not thrilled but they're not defeated either. They're not falling apart," Robert said.

The four suspects will have a full day to argue for bail on May 23.

Poor journalism, as usual. I have more questions coming out of this article than going in. Why did they get a standing ovation? Why are they being supported at all? What was the cause behind their actions? I'll take a guess that it has to do with the tuition hikes, but if you're going to link the article as a standalone piece, you can't just assume the reader is up to date on the case. It may seem silly for the one writing the article, but for goodness' sake, at least give all the pertinent facts. All it takes is one sentence. "Their actions were spurred on by... etc etc"

It was a dumb thing to do but falls short of anything to do with terrorism. Had the canisters contained sarin gas it would be a different story.
The media has everyone so hyped on the War On Terrorism that now there is an evil conspiracy in every unfortunate event.
Mischief is what it was and they should be convicted for it.

On the other hand, if there had been an overall panic in the fear that a real bomb was being thrown in, or if in their panic to get out of a smoke filled subway, and someone was pushed onto live tracks, or was crushed in a narrow hallway, would that not justify being charged with something other than simple mischief? Does it take YOU dying for it to warrant stronger charges? Would you be concerned then?

When Air Canada pilots declared a sick out and grounded 30% of the flights in Canada they disrupted people and could have caused accidents. It wasn't terrorism however.

Good question! The article says they got support from their families but if one of them were my kid, I would be standing there with a serious frown on my face as in "how could I have raised a child who cared so little about the safety of other people?"

Does anyone else see the irony in this?

These people are protesting tuition rates. And, most people go to university/college to get a better job/carreer.

Good luck getting a job once you've been charged with terrorism-related activities!

The statute they are prosecuting these people with has nothing to do with public safety and everything to do with oppression. The government is the one spreading fear of terrorism.

I say jail them. Maybe not for 5 years, but at least a few months. It will send a message that violence, and extreme acts like this won't be tolerated.

I'm 100% in favor of peaceful demonstration. It is a democratic right. But as always there's a small minority that take advantage of such situations to vandalism and cause chaos. Those people need to be apprehended and punished. And more importantly the leaders of the peaceful demonstrations need to publicly distance themselves from these wrongdoers in order to gain support of the population

Causing a panic situation where people could be injured and people with respiratory illnesses might have been impacted? Yeas, I think they should be charged.

Whereas the economic terrorism being leveled against (globally 100s of) millions of people is high-fived and rewarded as good business.

Once the criminals of economic growth face justice should people like this be singled out for inducing terrorism.

Another fail for Canadian jurisprudence.

Who are you talking about that is high-fiving 'economic terrorism'? And the only ones rewarding it as good business are the ones who are making the big bucks, the perpetrators of the economic terrorism. These young people are cry-babies and spoiled brats who use 'violence' and fear because no one is listening to their whining. They should go to jail for at least a couple years and then come out and try to get a job like the rest of the miscreants and felons that they aspire to be like.

The elite who stole billions from US homeowners, who use Western trade policy to coerce developing nations to restructure their economic and political frameworks to benefit Western consumerism while severely damaging their social and environmental sustainability, who lobby for downward pressure on wages and basic employment entitlements, and the list goes on and on.  These toads are high-fiving for the wealth that economic terrorism brings them and their corporations via globalization, which creates the social dysfunction necessary for protests, riots, smoke bombings, etc. to emerge.  The real felons are those that create the conditions for dysfunction by manipulating public policy to over-accumulate wealth.  
As long as we ignore who the real criminals are, the many, many protests raging across the globe will expand, each manifesting a little differently given local conditions.  Retired Canadian Gen. Rick Hillier stated essentially this after Egypt collapsed into chaos.  
Do your homework before rooting for the wrong side of history.

"...spreading fear of terrorism..." - How is it that Fox News isn't charged with that every week?

I would dismiss the claims of media bias except for the glaring omission of the suspects motives. I assume this is part of the protests against tuition hikes but it seems extremely odd that there is no comment, not even speculation, about the reason for the attacks.
