A B.C. man arrested in Montana on charges of abducting his three-year-old son is contesting his return to Canada.

Robert Barnett was taken into custody last Friday after an Amber Alert was issued for his son Alvin, who had been abducted from a supervised visit in Fernie, B.C.

Barnett, who is a dual Canadian-American citizen, appeared before a U.S. judge in Great Falls Monday and asked for extradition and bail hearings.

A hearing on his application for bail has been set for next Tuesday and the extradition hearing for Jan. 31.

Barnett remains in custody.

He was arrested in the Montana town of Whitefish last Thursday night, and his son, who was found unharmed, has since been returned to Canada.
