Movie star Randy Quaid was denied Canadian residency because of offences he’s alleged to have committed in the U.S., not because he doesn’t have a passport, CBC News has learned.

The one-time Oscar nominee took his battle to stay in Canada to Federal Court in Vancouver last month, at which time his wife, Evi Quaid, claimed he was rejected because he doesn't have a passport.

But according to documents obtained by CBC News and filed with the court last week, Quaid is inadmissable to Canada because he’s alleged to have committed an act that would be considered a crime in this country.

The documents say that in November, the FBI sent Citizenship and Immigration Canada a report saying Quaid still faces a count of defrauding an innkeeper in California, an act equated to mischief under Canada's Criminal Code.

Evi Quaid’s father was Canadian, meaning she could easily gain citizenship and her husband has applied as her spouse.

But Quaid was sent a letter by the ministry in December and told to leave the country immediately or face an order for his removal.

The Quaids surfaced in Canada in October 2010, claiming they were refugees from a Hollywood cabal of “star-whackers” who were conspiring to kill famous actors, and who had already taken the lives of stars Heath Ledger and David Carradine.
