The law generally requires people to appear before a judge within 24 hours of being arrested.
But that deadline has passed for Havis, who barricaded himself inside his house after a verbal altercation with workers on his lawn went awry.
Havis was injured during his arrest by rubber-coated projectiles, according to Montreal police.
His doctors have not yet cleared him for arraignment, and have said Havis has health issues that are both physical and emotional, according to Crown prosecutor Matthew Ferguson.
Neighbours of Havis claimed they have had verbal altercations with him before, with one woman saying Havis even threatened to kill her dog for being on his property.
Police said they recovered a stash of weapons from the house — Havis has a reported 182 guns registered under his name.
