The city of Montreal has been ordered to pay more than $132,000 to a woman who slipped and fell on an icy sidewalk.
Gertrude Forstinger was walking her dog on Jan. 5, 2012 when she fell and broke her wrist, according to CBC. The 58-year-old nurse testified that there was no salt or abrasives on the sidewalk, which was covered in a thin layer of ice.
Justice Suzanne Courchesne ruled the city didn't properly inspect sidewalks in the LaSalle neighbourhood, CJAD reported, and officials couldn't reasonably explain why no salt or sand had been spread on the ice.
Court documents showed the city hadn't laid anything on that part of the sidewalk for at least 48 hours before Forstinger fell, despite a -27 windchill, according to CBC.
The judge also noted that Forstinger wasn't rushing and had her dog under control, the Montreal Gazette reported.
Six-figure damage awards have a precedent in these sorts of lawsuits. In 2010, a Toronto man was awarded $288,000 after he fractured his ankle when he slipped and fell on an icy sidewalk.
