The Tory ad references "the tragic story'' of Allan Schoenborn, who in February 2010 was found "not criminally responsible'' on account of a mental disorder.
If the Crown succeeds, Allan Schoenborn will only be allowed to leave his psychiatric hospital for medical reasons.
Schoenborn's treating psychiatrist said that while the man is a "significant threat,'' he is a low risk to escape.
The Crown has 15 days to decide whether to appeal the decision.
