As the two-year anniversary of the tragic death of Sharon Jobson's son approaches, she faces a new challenge: a $500,000 lawsuit from CN Rail.
Jobson's son, John, was driving a truck that collided with a VIA train at an intersection near London, Ont., in July 2011, reports AM980 News.
Six out of the 116 passengers were hurt, and John died in the hospital days later.
CN Rail claims in a lawsuit that the railroad “incurred substantial expense to repair the extensive track damage in the vicinity of the level crossing... (and) significant resources and monies were expended by CN to repair and re-open the track."
The company says Jobson's son was negligent and "wholly responsible," the London Free Press reports.
The allegations have not been proven in court. CN Rail reportedly targeted the lawsuit at Jobson because she was the executor of her son's estate.
After the incident, Jobson convinced CN Rail and Transport Canada to budget $400,000 for safety equipment at the crossing where the accident took place, and a report from the Transportation Safety Board found the warning signs to be blocked by weeds, according to AM980.
“I thought the happy ending was (installation of) the lights and the gates,” she said. “Right in the guidelines they say, where there are double tracks, there shall be gates and lights."
Jobson's son was the second death to occur at the crossing, and she says it's time action is taken.
"We have to do something out here in the country, because we're having a lot of trouble with the railway and road equipment," she said.
"We need some safety out here in the country, and the guidelines aren't supporting our rural life."
Jobson has 20 days to file a statement of defence or launch a counter-suit.
