The Integrated Homicide Investigation Team says Clayton Marr was unconscious when police arrived at the house in the 27500 block of 32nd Ave. just before 8:30 p.m. PT Oct 1.
Sgt. Jennifer Pound says evidence retrieved at the scene, supports the theory Marr has broken into the house.
In response to the break-in, the owner and a neighbour tried to restrain Marr until police arrived, said Pound.
Pound say the unconscious 51-year-old was taken to hospital where he was pronounced dead.
She says given the initial evidence gathered at the scene, police made a decision to arrest the two men.
However, she says further investigation does not support the laying of charges at this time.
An autopsy has been scheduled to determine cause of death.
