The issue began back in July when a group of mothers filed a lawsuit against the state because of its refusal to give them documents for their U.S.-born children.
In order to obtain a birth certificate for a child, parents must provide proper ID, however Texas is refusing to accept most forms of ID available to undocumented immigrants. This includes the matrícula, which is a card issued by a local Mexican consulate, or a foreign passport unless it “bears a current U.S. visa.”
While the mothers claimed the state’s denial was discrimination, Texas argued that it was simply placing barriers for illegal immigrants to obtain birth certificates for U.S.-born children.
On Friday, U.S. District Judge Robert L. Pitman in Austin ruled that Texas can continue to deny birth certificates.
