Animal Cruelty Charge Laid For Racoon Beatings

(The Canadian Press) TORONTO - Residents of a Toronto neighbourhood awoke to horrifying sounds early Wednesday morning after a man allegedly attacked a family of raccoons with a shovel.

Toronto police say a man faces weapons and animal cruelty charges after officers were called to a home in the Bloor Street and Lansdowne Avenue area around 5:50 a.m.

Const. Victor Kwong says neighbours reported someone was attacking the raccoons in a backyard with a garden shovel.

Kwong says one of the baby raccoons was severely injured and it was originally thought the animal might have to be put down.

But an animal services official reports the baby suffered some broken toes and is being taken to a wildlife rehabilitation centre to recover.

"While this man was hitting the raccoons with a shovel, the mother raccoon was taking the other injured babies away," Kwong said, citing witness reports. "As for the other baby raccoons, we don't know (how they are) because the mother took them away."

After the incident, animal control officers looked for the other injured raccoons but couldn't immediately find them.

Dong Nguyen, 53, is charged with cruelty to animals and possession of a weapon for a dangerous purpose.

He was released and will appear in court July 13.

Fiona Venedam, a supervisor with Toronto Animal Services, says the one baby that was rescued was about one to two months old. Despite fears the raccoon's foot was broken, it now appears only some toes may be broken.

"He's a feisty little guy," Venedam said Wednesday afternoon.

Raccoons are a common sight in Toronto, especially at nighttime and during the early morning hours. But their nesting and foraging habits have earned them the wrath of many a homeowner and gardener.

Const. Wendy Drummond of Toronto police says people concerned about raccoons should ensure garbage -- an easy food source -- is not left outside where animals can get into it.

Lawns infested with grubs can also be "a feeding ground" for raccoons, so steps should be taken to get rid of them. Repellents such as pure soap flakes, diluted ammonia or diluted Tabasco sauce can be used around fruits and vegetables in the gardens.

"Ensure your property is well-maintained and make it an unattractive site for them to call home," Drummond said.

If those steps don't solve the problem, "There are services that you can hire to deal with the issue," she suggested.

Putting out poison, using firearms or using certain types of traps to deal with pests could bring criminal charges and fines of up to $5,000.

The maximum sentence for someone convicted of cruelty to animals is two years while conviction on a weapons dangerous charge can bring a sentence of up to 10 years.

Toronto Animal Services warns that raccoons are a major carrier of rabies in Ontario. People should stay away from wild animals, especially if they appear tame, injured or sick.

The sad reality is that, unlike in the U.S., people never do jail time for animal cruelty in Canada.
Canada's animal cruelty laws and the mechanisms of enforcement are perhaps the poorest in the western world. A decent animal cruelty act was passed years ago by parliament on three occasions and it was refused by the unelected Senate all three times, the first such case for a lwa in Canadian history. (Unlike Canada, the UK's unelected House of Lords had this power taken away quite a few years ago.) So--there MAY be a small fine for this, but nothing more.
About a decade ago, a Toronto art student and two friends skinned a cat alive on video as an "art project." Despite massive protests, the student was given a slap on the wrist, as were one of his friends who was "caught" after going AWOL for many months. The judge said his hands were tied by the current laws.
Subsequently, a friend of the "artist" made a film somewhat supportive of the horrendous treatment of the cat, a film that was accepted and shown, in spite of further protests, at the Toronto International Film Festival.

I'd like to put his loser butt in a locked room full of rabid raccoons and let them have a field day with him. Anyone who can abuse children or animals should be removed from this earth!

They don't mention the policy of removing captured racoons to within I believe, a half kilometer of the capture point. It's a bylaw. It's also why Toronto has the highest population of racoons of any major city.

And getting larger. The raccoon who I hosed 2 years ago had 4 babies, she must have had more and how many did the babies have?

My neighbourhood is quite bad for raccoons.

You may think this is funny stuff, but you should know that laws against cruelty to animals are in place to protect YOU and the public. People who harm animals, yes especially the cute ones, are likely to graduate to harming humans if they are not stomped on and flagged early on in their bloody careers. Cute animals are especially "protected" because call on the human instinct to protect cute children, and people without such empathy are sociopaths and psychopaths. Do you understand now? Cute animals are sentry, and they are protecting YOU.

Don't think of the racoons as pests or wild animals. They are literally canary sentry alerting us to the fact that there are human monsters living among us. If it was a child stomping on this guy's garden, I wouldn't be surprised if the sick SOB would use a shovel on him or her too.

Raccoons are only pests if you let them be, there are myriad ways to keep them at bay, deal with them if they encroach into your property, and there are a number of groups to call for advice - dealing with issues like this is just wrong on so many levels.

You sound like someone who has never dealt with them. I wouldn't smash them over the head with a shovel, but I think the local governments should provide removal services through tax funds. That way they would be more inclined to establish population control policies.

Raccoons get a lot of leeway because they are so darn cute. The fact is they are filthy, disease-ridden vermin that can cause thousands of dollars of damage to your house if they get into your attic, and are a great nuisance even if they don't. Going after any animal with a shovel is a horrible idea for lots of reasons, but in a multi-ethnic community like Toronto, you'll find people whose cultural background gives them a different approach to these creatures. It's very common for home-owners to trap them and drop them off in the country - that probably just means a slower, less dramatic death for them.

Humans get a lot of leeway too, and they are just as filthy and disease ridden at times.

Like most animal conflicts, there are always ways to deal with them humanely, heck, Toronto's news do stories on this year after year after year and there are hotlines and groups to call, savagely beating baby animals with a shovel is seriously phoocked-up, and if this just 'left over cultural baggage" from the mother land, well, we need to revisit immigration policies and redesign applications to gain entrance.

There is nothing cultural about it. I know of first generation Vietnamese-Canadians who would frown on what this sick SOB did. Sociopaths and psychopaths exist in all cultures.

If you are equating raccoons with humans, you're being silly. The only way to deal humanely with raccoons is to hire a professional removal service, and many people are unable or unwilling to pay for that. Even if you have a car and a humane trap and know the very specific way to trap them - it's still against the law to relocate wildlife and they will likely die anyway.

You know, I guess I can sort of understand why people would think racoons are pests, but they're just trying to survive, like the rest of us. What an awful man to be so cruel because his pathetic little backyard garden was dug up. Poor things! :(

I had one walk in my mothers cottage years ago when racoons did not usually come out in the day. I did what any woman would I put my daughter in a room closed the door and screamed.

The little devil had already had a beer at my cousins across the road they knew why I was screaming for help it was hissing. Perhaps the wrong brew.

I turn the hose on mine when they start tearing up the backyard. Mother and babies got the hose. It just took one more time coming out with the hose which they saw and they did not visit my property again. In fact a lot of the time they walk the fence in between the two properties rather than come on mine.
