Why are We Subsidizing Fake Canadian Beer?

David vs. Goliath is one of those rousing Bible tales that, over the course of several centuries, has become the template for so many stories found in fables, literature, and cinema. Thanks to the human proclivity for compassion and empathy, the idea of the scrappy little guy triumphing against all odds by taking on and defeating a big bad bully makes for heart-warming copy. (Cue Rocky theme music here ...)

Yet, the idea that big is bad and small is good isn't necessarily a truism. But another way, sometimes Goliath isn't really such a bad guy... and sometimes, David is, well, a bit of an opportunistic shyster.

Case in point: the ongoing saga in Alberta involving Calgary-based Minhas Craft Brewery. Minhas employs a PR strategy in which it fancies itself as a hometown David going up against a pair of ruthless, foreign-owned Goliaths in the form of Labatt and Molson.

As I reported last November, company co-owner Ravinder Minhas loves to play the victim card. And why not? By doing so, he received a tax subsidy under Alberta's deeply flawed small brewer tax program that amounted to $5.6 million in 2010. (The program was meant to usher in an environment that allows for local craft breweries to flourish; alas, the precise opposite has occurred.)

Indeed, while Ravinder Minhas likes to position his brewery as an all-Canadian little guy taking on the world, when one examines this brewery a little more closely, such is hardly the case.

For starters, as previously reported, all the Minhas brewing jobs are actually located in Monroe, Wisconsin. That wouldn't be so bad if not for the fact that Minhas has its beer taxed at a lower rate than the big breweries (which actually employ Canadians.) Translation: the Alberta government is essentially subsidizing U.S. brewing jobs with taxpayer money.

But a little recent investigative work has uncovered that Minhas also runs a company called Global Distillers SRL. Do a search of Global Distillers and it turns out that it is based in that great Canadian territory known as... Barbados.

In fact, it turns out that all of Minhas's trademarks are registered to a Barbados-based company (See here). So much for wrapping himself in the Canadian flag. Indeed, Ravinder Minhas is apparently funneling all his profits from the Alberta tax subsidy into an offshore tax-sheltered haven.

The bottom line? Minhas beer is brewed in the U.S., subsidized in Alberta, and sheltered from taxes in Barbados. Some local hero.

And it's a good thing Minhas doesn't have to slum it when he goes south. That's because he has a swank resort in the Barbados, too -- the lavishly-appointed Minhas Villa, where rooms go for US$299 to US$675 per night depending on the season. In fact, Minhas Villa is a delightful place for Canadians to seek refuge from winter and soak up the sun. And one can only wonder about how many Alberta government officials have relaxed on the beach revelling in epic bonfire side stories of Minhas' small business heroics against the "big multinationals."

But alas, Minhas' business plan -- i.e., its reliance on Alberta tax subsidies -- has hit a snag. Based on his overall beverage production (which includes beer, soft drinks and spirits), Minhas is very likely over the 400,000-hectolitre limit. If so, according to the regulations, Minhas no longer qualifies for Alberta small brewer subsidies.

Which means the savvy entrepreneur is now employing Plan B: Minhas is supposedly building a new brewery in Calgary that is supposed to be opening in March 2012.

Situated in an industrial space that is less than 5,000 sq. ft., this facility will output less than one per cent of the volume of his 300,000 sq. ft. Wisconsin brewery (which pumps out 351,000 hectoliters of beer, making Minhas the 14th largest brewer in the U.S.).

Announced in a letter widely distributed into the Alberta government in late November, there is no doubt that Mr. Minhas' postage-stamp sized brewery is being played for all its worth. What better way to lobby for continued and increased Alberta government subsidies than touting Alberta "jobs and investment" -- even if the value of both are outstripped by the rich annual subsidies to Minhas' U.S. operations by an order of magnitude.

There are two sides to every story, of course. Except that when it comes to the Minhas file, nobody's talking. Alberta Gaming and Liquor Commission CEO Gerry MacLennan declined to comment. And shockingly, Ravinder Minhas -- who is somewhat of a media darling as long as the questions are softballs -- abruptly terminated our phone conversation without answering a single query.

Even so, the ball is now in the AGLC's court. Namely, will it revamp the regulations and continue to subsidize a brewery that brews all its beer in the state of Wisconsin and is essentially a Barbadian, not a Calgarian company? Or will the AGLC actually show some respect for Albertan taxpayer dollars and turn off the taps?

I enjoy Minhas beer and look forward to their opening of the brewery in Calgary ! This article is a bunch of non-sense to me, David you can tell your biased, why even hide it now?

Is'nt this what Globalization and International Trade is all about?

Stop all corporate welfare and second guessing. Just tax evenly and spend on programs. Leave the economy to the people. Government is stupid. Until they realize that, we are in trouble.

I find it interesting that 4 or 5 of the comments criticizing the article are from users that registered this month, and this is their first comment. Is the beer that good that it invokes this kind of passionate response. Well, I had the misfortune of having tasted it, so that clearly can't be the case. One comment was that they "love the marketing". Wow. Really? It may appear to some that an interested party has individuals trying to deflect the criticism of certain business practices. But hey, if the Alberta taxpayer wants to subsidize a brewery in Wisconsin, so be it. I am sure they folks there appreciate the jobs.

This seems like an attack ad against a Minhas'! I am familar with thier beer havnt tried it but will now. I thank the Alberta Government for bring variety of beer to the province, i use to live in Saskatchewan and the beer selection stinks! I don't care where the beer is made just where it is sold! Indepedant business is always better than monopoly of foreign owned brewers like Molson and Labatt who both have shut down majority of thier breweries in Canaa. Did you know that Molson doesn't have a Brewery in Alberta, Sask or Manitoba and labatt is no much better.... But they are very good at buying up NHL sponsorships and charging to much for sub-standard beer!!

I like what the Minhas' have done to the beer business and love thier marketing, I just thought this should be said!

It's quite obvious that most of the posts so far are from first time posters, responding to this story. It's interesting how many first time posters are on the side of Mr Minhas in this case, seems a little stacked.
WHich province gives Molson and Labbat a legalized monopoly?
So you are saying this province will not allow any other brewers to exist? As far as I know every province I have ever been in has it's share of breweries. And in most Molson or Labatts are the biggest, but monopoly?
Methinks you don't know what that word really means. Every time I walk into a liquor store I see an abundant amount of different beers.

This article seems incredibly biased...could there be some ulterior motive behind it?? Alberta privatizes liquor and beer prices have been brought down thanks to the Minhas'. This seems like a lose / lose scenariou you've painted here. David, first you have a problem with the brewery in Wisconsin and now you have a problem with there one being built in Calgary. I am looking forward to the brewery in Calgary and I am certain it will create jobs here.

Thanks for an article that seems completely one-sided.

WHat are you talking about beer and alcohol are just as or more expensive, I smell a coproate shill here. I have a problem when a business uses shady practices like the ones suggested here. Now if there was anything wrong with what Mr Menezies can be sued by the company.
The last two comments look like they were written by Mr Minhas himself.
I do not believe he deserves these subsidies if the work is done in Wisconsin, if he has done some shady book keeping it needs to be investigated.

At least somebody is keeping the beer prices down. I would rather support our largest trading partner with jobs as opposed to moving them overseas like the majority of other corporations.

Shouldn't you be blasting the government rather then the producer. Regardless of your points, (which seem untrue, since you are assuming a lot of this) he is probably the single force keeps the prices down, as opposed to the monopoly that Molson and Labatt have created. Good to see you are cross referencing your own stories. Really makes it seem legitimate. Fantastic Journalism. If you cared about the consumer Minhas should be applauded.

Beer quality aside, it doesn't bother you that YOUR tax dollars are going to what amounts to a medium sized corporation whose jobs are all based in another country and whose profits seem to leave Canada?

Burt I look this the same as the federal small business tax, A small business like mine doesn't pay the same as larger corporations, this to encourage small business as we all know competition is good for any economy. Also the large oil companies I partner with pay more royalty than me as they have the economy of scale and make more per barrel of oil. This is no different. As for profits leaving well they are making a brewery in Calgary, that looks like reinvesting of profits to me, also I see Minhas' commercials on local channels like Global and CityTV all the time, I don't see any other smaller producers doing just the Minhas' and then of course big international brewers... As for beer quality i enjoy Mountain Crest and love the price, I treid Beer Beer and thought it was horrible beer... lousy can and lousy taste.... But hey thats just my opninion, that why i like competition I can have a favourite and you can have yours. I just don't get the big deal where it is beer made rather how it taste.

The Alberta taxpayers should sue their government for misused funds. I do support tax breaks and low-interest rates for starting businesses, but I do not believe in providing subsidies to established businesses, especially those not even in our country. This is the kind of theft that the 1% have been pulling on us for decades, and getting away with it I might add. We need to start taking this sort of thing more seriously. People should go to jail over this. Government officials should be held financially liable for the misspent funds, including the party funds. There is no reason to accept this sort of blatant theft any longer.
